HMRC's IR35 help 'not a replacement for independent advice'
Those looking for advice on IR35 can benefit from a new walkthrough off HMRC's guide to the topic.
A new guide has been released for contractors looking to understand the online information and advice offered by HM Revenue and Customs (HMRC) on IR35.
Contractor Calculator has highlighted the impact that being found to operate within IR35 can create and stated that this is a highly complex area of law, where seeking the help of an expert – such as a contractor umbrella company – could be necessary.
The website highlighted the resources available on the HMRC site for determining whether or not a contractor should be classed as an employee for the purposes of paying tax.
Despite these resources, the guide emphasises the importance of seeking out advice from a third-party who specialises in this field.
It stated: "Contractors should always ensure they check all contracts with an independent IR35 and employment law expert and, if possible, ensure that tax investigation insurance cover is in place."
Earlier this month, the Financial Times reported that the ambiguity surrounding whether the government is to make changes to IR35 legislation is keeping many contractors waiting.
